- End-customer communication data: phone numbers and SMS message content from conversations handled by our AI on your behalf
- Usage data: how you interact with our platform, including login times, features used, and conversation logs
- Technical data: IP addresses, browser type, and device information collected automatically when you use our website
3 How We Use Your Information
We use collected information to:
- Provide, operate, and maintain our AI communication services
- Process billing and manage your account
- Send you service updates, receipts, and support communications
- Generate the monthly conversation reports included in your plan
- Improve our AI models and service quality (using anonymized, aggregated data only)
- Comply with legal obligations
4 SMS and Text Message Data
By using Pintail, LLC's missed call text-back service, your business clients consent to receive automated SMS messages. You are responsible for ensuring your end-customers have a reasonable expectation of receiving such messages, as described in our SMS Policy.
5 Sharing Your Information
We do not sell your personal information. We may share information in the following limited circumstances:
- Service providers: We use Twilio (SMS delivery), OpenAI (AI processing), and Make.com (automation). These providers process data on our behalf under confidentiality agreements
- Legal requirements: If required by law, court order, or government authority
- Business transfers: In the event of a merger or acquisition, data may transfer to a successor entity
- With your consent: Any other sharing requires your explicit permission
6 Data Retention
We retain your account and business data for the duration of your subscription and for up to 12 months after cancellation, for billing and dispute resolution purposes. SMS conversation logs are retained for up to 12 months. You may request earlier deletion by contacting us at ben@pintailhq.com.
7 Security
We implement industry-standard security measures including encrypted data transmission (HTTPS/TLS), access controls, and secure cloud infrastructure. No method of transmission over the internet is 100% secure, but we take reasonable precautions to protect your information.
8 Your Rights
You have the right to:
- Access the personal data we hold about you
- Request correction of inaccurate data
- Request deletion of your data (subject to legal retention requirements)
- Opt out of non-essential communications at any time

1 Acceptance of Terms
By signing up for or using Pintail's services, you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business, you represent that you have the authority to do so. If you do not agree to these Terms, do not use the service.
2 Description of Service
Pintail LLC provides AI-powered communication tools for small businesses, including but not limited to missed call text-back, AI conversation handling, appointment booking assistance, and related features. Services are provided on a subscription basis and may be updated or modified over time.
3 Eligibility and Account
- You must be at least 18 years old and operate a legitimate business to use Pintail, LLC
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information during registration
- You are responsible for all activity that occurs under your account
- Notify us immediately at ben@pintailhq.com if you suspect unauthorized account access
4 Acceptable Use
You agree not to use Pintail, LLC to:
- Send unsolicited, deceptive, or spam messages to recipients who have not interacted with your business
- Violate any applicable federal, state, or local law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
- Transmit harmful, harassing, defamatory, or fraudulent content
- Impersonate another person or business
- Attempt to reverse-engineer, hack, or disrupt the service
- Resell or sublicense the service without written permission
5 Subscription and Payment
- Subscriptions are billed monthly in advance on the date you first subscribe
- All fees are non-refundable except as required by law or expressly stated otherwise
- We may change pricing with 30 days' written notice to active subscribers
- Failure to pay may result in service suspension after a 7-day grace period
- You may cancel at any time; cancellation takes effect at the end of the current billing period
6 Service Availability
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (including Twilio or OpenAI), or circumstances beyond our control may result in temporary unavailability. We will make reasonable efforts to notify clients of planned maintenance in advance.
7 AI-Generated Content
Our AI generates responses on behalf of your business based on information you provide. You acknowledge that:
- AI responses may occasionally be inaccurate, incomplete, or inappropriate for the context
- You are responsible for reviewing the system prompt and business information you configure
- Pintail, LLC is not liable for decisions made by your customers based on AI-generated content
- You should monitor AI conversations and provide feedback to improve accuracy
8 Intellectual Property
Pintail, LLC retains all rights to its platform, software, and AI systems. You retain ownership of your business data and conversation logs. You grant Pintail LLC a limited license to process your data solely to provide the service.
9 Limitation of Liability
To the maximum extent permitted by law, Pintail, LLC's total liability to you for any claims arising from the use of the service shall not exceed the amount you paid to Pintail LLC in the three months preceding the claim. Pintail LLC is not liable for indirect, incidental, or consequential damages, including lost revenue or lost customers.
10 Termination
Either party may terminate the service with 30 days' written notice. Pintail, LLC reserves the right to suspend or terminate your account immediately for material violations of these Terms, including illegal use of SMS messaging or non-payment.
11 Governing Law
These Terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Kent County, Michigan, unless otherwise agreed in writing.

1 Program Description
Pintail, LLC operates an automated SMS messaging system that sends text messages on behalf of small business clients when their customers call and do not receive an answer. Messages may include appointment booking assistance, answers to frequently asked questions, general business information, and escalation of urgent inquiries.
2 Message Frequency
Message frequency varies. A customer who misses a call from a Pintail-powered business will receive one initial automated text. Additional messages are sent only if the customer replies and continues the conversation. Typical exchanges are 2–6 messages per interaction.
3 How to Opt Out
To stop receiving messages, reply STOP to any message at any time. You will receive a single confirmation message and no further messages will be sent to your number. To re-subscribe, reply START.

Pintail, LLC's SMS service works with all major US carriers, including AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Cricket, and others. Carrier support may vary for some regional carriers.
7 Privacy of SMS Data
